Terms of Service

These Terms of Service (“Terms”) govern your use of the Promptation website, desktop application, and API services (collectively, the “Services”) provided by Promptation (“we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Services. By creating an account, you represent that you meet these requirements.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to the Services, other accounts, or connected systems
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Interfere with or disrupt the Services, servers, or networks
  • Transmit malware, spam, or other harmful content
  • Use the Services to generate content that is illegal, harmful, or violates third-party rights
  • Exceed reasonable usage limits or abuse rate limits

4. Your Content

You retain ownership of all content you create within the Services (prompts, templates, workspace data). By using the Services, you grant us a limited license to store, process, and display your content solely to provide the Services to you.

We do not use your content to train AI models or share it with third parties, except as necessary to provide the Services (e.g., sending prompts to your configured AI providers).

5. Third-Party AI Providers

The Services allow you to interact with third-party AI providers (e.g., OpenAI, Anthropic, Google). Your use of those providers is subject to their respective terms of service. We are not responsible for the content, accuracy, or availability of third-party AI outputs.

6. Intellectual Property

The Services, including all software, design, branding, and documentation, are owned by Promptation and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

7. Subscriptions & Payments

Some features of the Services may require a paid subscription. Pricing, billing cycles, and payment terms will be communicated at the time of purchase. All fees are non-refundable unless otherwise stated or required by law.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with advance notice when possible
  • Modify, update, or discontinue features at our discretion
  • Suspend access during security incidents or abuse investigations

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided “as is” and “as available” without warranties of any kind.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim arising from or related to the Services shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless Promptation from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.

11. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice. Upon termination, your right to use the Services ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website. Continued use after changes take effect constitutes acceptance of the new Terms.
